GENERAL TERMS AND CONDITIONS OF USE

 

Welcome to BETANO NEWS, an online sports news website operated by Digify International Limited, a company incorporated and existing under the laws of Malta, having its registered office at Unit 41/42, Level 4, Pendergardens Business Centre, Triq Sant’ Andrija, San Ġiljan, STJ 9023, Malta, and registered with the Maltese Business Registry under No. C82335 (“BETANO NEWS”, “we”, “us” or “our”).

These General Terms and Conditions of Use (“Terms”) govern every visit to, and all use of, the publicly accessible website currently available at www.betano.news and any sub-domain, successor, or replacement site (collectively, the “Site”). By accessing, browsing, or otherwise using the Site, you (“you” or “User”) acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any provision herein, you must refrain from using the Site.

1.1 Subject to your ongoing compliance with these Terms, BETANO NEWS grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Site solely for your personal, non-commercial, and lawful purposes.

1.2 The Site is provided solely for informational purposes. BETANO NEWS does not require Users to create an account or log in. All content is available without registration, and Users are reminded that any future interactive features will be governed by additional terms that will be made available at the relevant time.

1.3 BETANO NEWS reserves the right, at any time and without prior notice, to modify, suspend, or discontinue the Site or any part thereof, to restrict access to some or all Users, and to impose limits on certain features or services. BETANO NEWS shall not be liable to you or to any third party for any modification, suspension, discontinuance, or unavailability of the Site.

1.4 Without limiting Section 1.3, BETANO NEWS shall not be liable for any failure or delay in providing the Site or Content resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, failure of third-party data providers, internet or telecommunications outages, cyberattacks, government actions, or cancellation or postponement of sporting events.

2.1 The Site, together with all text, articles, photographs, images, graphics, audio and video clips, live scores, data feeds, software, code, and other materials contained therein or otherwise made available through the Site (collectively, the “Content”), is the exclusive property of BETANO NEWS or its licensors. All Content is protected by Maltese, EU, and international copyright, database, trademark, and/or other intellectual property laws.

2.2 Except as expressly permitted in Section 3 (Sharing of Articles) or by mandatory provisions of applicable law, you may not reproduce, distribute, publicly display, perform, publish, transmit, adapt, edit, translate, modify, create derivative works from, disassemble, decompile, reverse engineer, or otherwise exploit any portion of the Site or Content without BETANO NEWS’s prior written consent.

2.3 All trademarks, service marks, trade names, logos, trade dress, and other source identifiers displayed on the Site (collectively, “Marks”) are the sole property of BETANO NEWS or its licensors. Nothing in these Terms or on the Site shall be construed as granting you any license or right to use any Mark without BETANO NEWS’s express prior written permission.

2.4 BETANO NEWS holds press publisher rights over its publications in accordance with Article 15 of Directive (EU) 2019/790 of the European Parliament and of the Council. Third parties, including but not limited to online content-sharing service providers, news aggregators, media monitoring services, and platforms, are hereby put on notice that the reproduction or making available to the public of BETANO NEWS’s press publications (or any extract thereof) for online use requires BETANO NEWS’s prior authorization and, where applicable, fair and proportionate remuneration. Nothing in these Terms constitutes a waiver of BETANO NEWS’s press publisher neighboring rights.

3.1 The Site may incorporate functionality that allows you to share links or excerpts of articles via social media, e-mail, or other third-party services (the “Sharing Tools”). You may use the Sharing Tools solely to share unaltered, verbatim links or excerpts that BETANO NEWS expressly makes available for such purposes, provided that you do not remove or modify any proprietary notices, attribution, or functional links back to the original article on the Site.

3.2 You must not present shared Content in a manner that suggests sponsorship, endorsement, affiliation, or other relationship between BETANO NEWS and any third party, unless expressly authorized by BETANO NEWS in writing.

3.3 BETANO NEWS reserves the right, at its sole discretion, to disable, limit, or revoke your ability to share Content at any time and for any reason, including violation of these Terms.

3.4 BETANO NEWS may from time to time receive unsolicited ideas, suggestions, story leads, photographs, videos, or other materials from Users (“Submissions”). By sending any Submission to BETANO NEWS, you agree that: (a) the Submission is non-confidential and non-proprietary; (b) BETANO NEWS may use, reproduce, distribute, or publish the Submission, in whole or in part, without compensation or attribution to you; and (c) BETANO NEWS is under no obligation to review, acknowledge, or respond to any Submission. You represent and warrant that you have all necessary rights to grant the foregoing permissions and that the Submission does not infringe the rights of any third party.

4.1 You agree that you will not, directly or indirectly:

(a) use the Site or Content for any unlawful, fraudulent, defamatory, harmful, obscene, or otherwise objectionable purpose;

(b) use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site;

(c) harvest, collect, or store information about other Users, or scrape, crawl, or otherwise systematically extract data from the Site, including by use of automated scripts, bots, or similar technologies. Without limiting the generality of the foregoing, BETANO NEWS expressly reserves its rights under Article 4(3) of Directive (EU) 2019/790 to opt out of text and data mining for commercial purposes, including but not limited to the training of artificial intelligence or machine learning models. This reservation of rights applies to all Content on the Site and is also expressed in machine-readable form in accordance with applicable law;

(d) introduce any viruses, worms, trojans, logic bombs, or other malicious or technologically harmful material to the Site;

(e) circumvent, disable, or otherwise interfere with security-related features of the Site or features that enforce limitations on use or access to the Site or the Content; or

(f) take any action that imposes or may impose, in BETANO NEWS’s sole judgment, an unreasonable or disproportionately large load on the Site’s infrastructure.

4.2 BETANO NEWS may investigate any violation of these Terms or misuse of the Site and may cooperate with law enforcement authorities in prosecuting Users who violate applicable laws.

 

5.1 The Site and all Content are provided “as is” and “as available” without warranty of any kind, express or implied. Without limiting the foregoing, BETANO NEWS expressly disclaims any and all warranties of accuracy, completeness, reliability, timeliness, non-infringement, merchantability, and fitness for a particular purpose.

5.2 Although BETANO NEWS strives to provide accurate and timely sports news, videos, and live scores, the nature of sporting events, third-party data feeds, and evolving circumstances means that errors, delays, interruptions, inaccuracies, or omissions may occur. BETANO NEWS does not warrant that the Site or Content will be error-free, uninterrupted, secure, or free from viruses or other harmful components, or that any inaccuracies will be corrected. BETANO NEWS does not guarantee the immediacy or accuracy of any real-time data and shall not be liable for any loss or damage arising from reliance on such data.

5.3 BETANO NEWS is committed to accuracy in its reporting. If an error is identified in any published Content, BETANO NEWS will endeavor to correct or clarify the relevant article in a timely manner. However, BETANO NEWS does not guarantee that all errors will be identified or corrected, and the publication of a correction does not constitute an admission of liability.

BETANO NEWS does not control and is not responsible for the availability, accuracy, or legality of any Embedded Content, and the display of Embedded Content does not imply endorsement by BETANO NEWS. Embedded Content may be removed or become unavailable at any time without notice.

5.6 The Site is of purely informational and editorial nature, providing opinion pieces and updates on sports events and news. 6.2 Nothing in these Terms excludes or limits BETANO NEWS’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under mandatory law.

You agree to indemnify, defend, and hold harmless BETANO NEWS and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

(a) your willful or grossly negligent misuse of the Site or Content;

(b) your infringement of BETANO NEWS’s intellectual property rights; or

(c) your violation of any applicable law through your use of the Site.

8.1 BETANO NEWS reserves the right, at its sole discretion, to modify or replace these Terms at any time.

8.2 For material changes to these Terms, BETANO NEWS will publish a notice on the Site within a reasonable time before such changes take effect. The notice will indicate the nature of the changes and the date on which the revised Terms will become effective.

These Terms and any dispute arising out of or relating to them, the Site, or the Content, shall be governed by and construed in accordance with the laws of Malta. The courts of Malta shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject always to any mandatory right you may have, as a consumer residing in the European Union, to bring proceedings in the court of your domicile.

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified so as to be valid and enforceable to the maximum extent permitted by law.

Failure by BETANO NEWS to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed by BETANO NEWS in writing.

These Terms constitute the entire agreement between you and BETANO NEWS relating to your use of the Site and supersede any prior or contemporaneous oral or written communications, proposals, or representations with respect to the Site or any Content.

You may not assign, delegate, or transfer any of your rights or obligations under these Terms without BETANO NEWS’s prior written consent. BETANO NEWS may freely assign or transfer its rights and obligations hereunder without restriction.
